DESCRIPTION:
In accordance with FAR 7.107-3 and 15 U.S.C. § 657q, the U.S. Army Corps of Engineers, Portland District, provides public notice of its determination to consolidate contract requirements for design-build and design-bid-build construction services across the Northwestern Division (Portland, Seattle, and Walla Walla Districts).
Consolidation Determination:
The Contracting Officer has determined that consolidation of these requirements is necessary and justified in accordance with FAR 7.107-2. The consolidation will establish a single Multiple Award Task Order Contract (MATOC) with an estimated total capacity of $99,000,000 over a five-year base period.
Requirements Being Consolidated:
This consolidation will replace various stand-alone contracts previously awarded for repair and maintenance of real property and construction services, including new construction and renovation to large civil works projects. Work includes flood control and hydroelectric dams, river navigation facilities, maintenance and office facilities, roadways and recreation facilities, and river levees across three districts.
Anticipated Benefits:
The quantified benefits of consolidation total $17,584,365 (17.8% of contract value), substantially exceeding the FAR 7.107-2(d)(1)(ii) threshold of $9.4M. Benefits include:
• Procurement cost savings: $1,116,265 (56% reduction vs. stand-alone contracts) • Revenue protection: $15,668,100 (140-day PALT reduction protecting hydropower generation) • Administrative efficiency: $800,000 (reduced overhead for 1 MATOC vs. 25 stand-alone contracts)
Small Business Considerations:
This procurement constitutes substantial bundling under FAR 2.101 (total value exceeds $8M threshold). The agency has assessed barriers to small business participation and determined they are minimal and adequately mitigated through:
• Total Small Business Set-Aside (100% of contract value reserved for small business) • Multiple awards (3-5 contractors) • Reasonable task order sizing ($1.5M-$10M, within NAICS 237990 size standard) • Minimum guarantees ($3,000 per awardee) • Teaming provisions (FAR 52.207-6)
Market research identified 18 capable small businesses, and 5 historical MATOCs successfully utilized small business pools for identical scope.
