Notice of Intent to Sole Source – Advanced Contract Initiative (ACI) Regional Debris Management Services: Region 3 – Great Lakes and Ohio River Division (LRD)

DESCRIPTION

Intent to Sole Source: The U.S. Army Corps of Engineers (USACE), Rock Island District (CEMVR), intends to execute a bilateral contract modification to extend the ordering period and increase the contract capacity under Firm-Fixed-Price (FFP) Single Award Task Order Contract (SATOC) W912EK22D0006 with DRC Emergency Services, LLC (6702 BROADWAY ST, GALVESTON, TX 77554).

This action is being conducted under statutory authority Title 10 U.S.C. § 3204(a)(1), as implemented by FAR 6.302-1(a)(2)(iii)(B): Services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency's requirements.

Summary of Proposed Modification

1. Ordering Period Extension: The existing contract currently expires on November 9, 2026. This action extends the ordering period to maintain continuous response capability pending award of the competitive follow-on contracts.
2. Capacity Increase: Adds sufficient emergency contract capacity to ensure uninterrupted operational capability for unforeseen, newly declared disaster events.
3. Requirement: Rapid-response debris management services under FEMA Mission Assignments (ESF #3. Contractors must be capable of deploying, mobilizing labor/equipment, and commencing debris reduction and disposal across disrupted operational areas within 24 hours of notification. Services shall be performed in accordance with the attached Performance Work Statement (PWS).

Note: The Government is actively conducting a full and open competitive acquisition for the successor ACI Debris Management contracts, with contract awards anticipated in 2027. This bridge action is solely intended to prevent an operational capability gap during contract transition.

Capability Statements & Submission Instructions

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and no formal solicitation will be issued. A determination by the Government not to compete this proposed action based upon responses received is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement.

Interested firms, believing they can meet this emergency requirement without causing unacceptable delays in mission execution, may submit a written capability statement. Responses must clearly demonstrate:

• Verifiable capability to mobilize personnel, heavy equipment, subcontractors, and management assets within 24 hours across the Region under severely degraded infrastructure conditions in accordance with the attached PWS..
• Experience managing concurrent, multi-stream disaster debris operations (vegetative, C&D, hazardous materials, and white goods) under large-scale FEMA mission assignments as outlined in the attached PWS.
• Adequate financial resources and capacity to support major surge operations.

Responses must be submitted via email to the Point of Contact below no later than October 15, 2026 at 2:00 P.M. Central Time. The Government will not reimburse any costs associated with responding to this notice.
