This is a notice of intent sole source for commercial items in accordance with Revolutionary Federal Acquisition Regulations Overhaul (RFO FAR) Part 5 and Part 12, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested.
The Department of Homeland Security (DHS), Office of Health Security (OHS) intends to negotiate a commercial FAR (RFO) Part 12, firm-fixed priced, purchase order on a sole source basis with Vital Group Solutions, LLC (4760 S Pecos RD, Las Vegas, Nevada 89121-6038 United States. UEI: JZ2AJ2KAZE17) for expedited sourcing and delivery of FedMed FOMS GoClinic Loadouts and FedMed FOMS MOBAR System medical supplies and equipment in support of the DHS OHS’s emerging mission requirements.
This acquisition is being conducted in accordance with FAR (RFO) Part 12 procedures (specifically subpart 12.102(a)) in accordance with (FAR) Class Deviation Number 25-21, Revision 1, allowing the Contracting Officer (CO) to solicit from only one source. The North American Industry Classification System (NAICS) code for this acquisition is 423450 - Medical, Dental, and Hospital Equipment and Supplies Merchant Wholesalers, with a size standard of 500 employees. This acquisition is a total set-aside for small business concerns. This notice is posted in accordance with FAR (RFO) subpart 5.101.
OHS is the principal medical, workforce health and safety, and public health authority for DHS. Since the inception of DHS, health security has played a pivotal role in the execution of the Department’s mission. The Office of Health Security positions the Department for a proactive and agile response to the evolving health security landscape. OHS was created via bipartisan and bicameral legislation which permitted the Department to effectuate a mission-targeted reorganization solely focused on departmental workforce health, safety, and medical functions. The roles, responsibilities and authorities of the Department’s Chief Medical Officer and OHS are found in statute including 6 U.S.C. § 350, 6 U.S.C. § 597, 6 U.S.C. § 597a, and 6 U.S.C. § 321q. These authorities are further reinforced via DHS Delegation 26000, Designation 00-26000 (Designated Agency Safety and Health Official), Designation 00-26002 (Anomalous Health Incident Agency Coordination Lead), and numerous Directives and Instructions. Additionally, OHS is responsible for the oversight and implementation at DHS of numerous government-wide authorities such as those related to Employee Assistance Programs and Health Service Programs (5 U.S.C. § 7901) and Worker’s Compensation Programs (5 U.S.C. § 8101, et seq). OHS also provides significant health leadership and support to ensure that the Department effectively carries out responsibilities related to immigration health under 42 U.S.C. § 249 and the due process clause of the 5th Amendment.
In support of this mission, the DHS OHS has an immediate and urgent requirement to procure specialized emergency medical services equipment and supply kits. The specialized kits will be utilized by OHS Field Medical Operations in support of force health protection and operational medicine activities during the 2026 FIFA World Cup, Freedom 250 (America’s 250th Birthday), and other short-term special events with a high-threat environment and public safety concerns. Additionally, pursuant to statutory authority in 6 USC 597a, OHS clinicians will utilize the equipment in the provision of operational medical support to U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection during immigration enforcement, removal and repatriation operations, and provision of such support to the U.S. Secret Service as part of the OHS Protective Medicine Program.
