1. Request for Quotation
This is a Request for Quotation for commercial services, specifically commercial construction, prepared in accordance with RFO FAR Part 12, as supplemented by applicable construction requirements in RFO FAR Part 36, VAAR Part 836, and VAAR Subpart 819.70.
Solicitation number 36C24126Q0607 is issued as a Request for Quotations (RFQ) for a firm-fixed-price commercial construction project to address the uninterrupted power supply (UPS) systems at two locations, Bangor and Lewiston Outpatient Clinics, by replacing the old UPS systems with new ones.
2. Commercial Construction Determination
The Department of Veterans Affairs is acquiring this requirement as a commercial service under RFO FAR Part 12. The requirement is for construction services of a type offered and sold competitively in substantial quantities in the commercial marketplace, based on established catalog or market prices for specific tasks performed or specific outcomes to be achieved, and under standard commercial terms and conditions.
Although this acquisition is conducted under Part 12, the resulting contract will include applicable construction requirements, including wage rates, specifications, safety, site investigation, contract administration, work coordination, and closeout requirements.
3. Description of Requirement
The project requires a contractor to replace the existing Mitsubishi 2033C UPS systems at the VA Maine Bangor and Lewiston outpatient clinics by procuring two new 20kVA, 208V, three phase VRLA battery UPS units, installing them in the same locations as the old equipment, performing all necessary electrical work including running new wiring and installing breakers if existing infrastructure is incompatible and completing startup and commissioning after hours to avoid interrupting critical clinic operations. The contractor must also remove and properly dispose of the old UPS units and associated electrical materials, provide disposal receipts, obtain required electrical renovation permits, and warrant all work for one year, with all tasks completed within a 90-day performance period.
The Contractor shall perform all work in accordance with the Attached Statement of Work, specifications, applicable codes, wage determination, site requirements, and all terms and conditions of the solicitation and resulting contract.
4. Period of Performance
The period of performance shall be 90 calendar days after issuance of the Notice to Proceed.
The Contractor shall not begin physical work on site until the Contracting Officer issues a written Notice to Proceed and the Contractor has submitted all required documentation, safety plan, schedule, and pre-performance submittals.

Offerors are responsible for examining the site and satisfying themselves as to existing conditions, site access, utility constraints, staging limitations, security requirements, and all other matters that may affect performance.
6. Request for Information
Questions shall be submitted in writing to the Contracting Specialist at Alexandru.Sava@va.gov no later than 04:30PM on September 3rd, 2026.
The Government will not respond to oral questions. Answers will be issued by amendment to the solicitation.
7. Quotation Submission Instructions
Quotations shall be submitted electronically to the Contracting Specialist at Alexandru.Sava@va.gov no later than 04:30PM on September 8th, 2026.
Each quotation shall include:
1. Completed pricing for CLIN 0001.
2. Technical approach, including construction means and methods, phasing, schedule, safety, quality control, facility-protection measures, and coordination with VA operations.
3. Evidence of recent relevant construction experience of similar size, scope, complexity, and operating environment.
4. Proposed superintendent and key personnel qualifications.
5. Acknowledgement of all amendments.
6. SAM Unique Entity ID and confirmation of active SAM registration.
7. Any exceptions, assumptions, or deviations.
The Government may reject a quotation that takes exception to material solicitation requirements.
8. Evaluation and Basis for Award
The Government intends to award one firm-fixed-price contract to the quote responsible, whose quotation conforms to the solicitation and represents the best value to the Government. In accordance with, ADDENDUM to 52.212-2 EVALUATION COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (DEVIATION AUG 2025) Award will be made using the following factors:
Factor 1 - Technical Approach
The Government will evaluate whether the quotation demonstrates an adequate understanding of the work and a realistic approach to completing the project. The quotation should address schedule, sequencing, site logistics, safety, quality control, protection of existing VA facilities, utility coordination, and closeout.
Factor 2 - Relevant Experience / Past Performance
The Government will evaluate recent and relevant construction experience of similar size, scope, complexity, and operating environment. The Government may consider information provided by the quoter and information obtained from other sources.
Factor 3 - Price
The Government will evaluate price for reasonableness and, if necessary, realism to determine whether the price reflects a clear understanding of the work.
The Government may award without discussions. The Government may reject any quotation that is incomplete, unreasonably priced, technically unacceptable, or otherwise fails to conform to the solicitation.
9. Responsibility
To be eligible for award, the apparent successful quoter must be determined responsible. The Government may consider, among other matters, financial resources, construction experience, safety record, integrity, business ethics, organization, equipment, personnel, subcontractor management, and ability to comply with the required performance schedule.
10. Wage Determination and Labor Standards

The wage determination is incorporated into the solicitation and resulting contract.
11. Payments and Invoicing
Payments shall be made under the contract payment clauses for fixed-price commercial procedures. The Contractor shall submit a schedule of values, progress payment requests, supporting documentation, and certifications required by the contract.
Invoices shall be submitted through the VA Invoicing System, Tungsten.
12. Safety, Security, and Facility Requirements
The Contractor shall comply with all applicable Federal, state, local, OSHA, VA, and facility-specific safety and security requirements.
Contractor personnel shall comply with VA access, badging, escort, parking, patient-safety, privacy, restricted-area, utility outage, and communications requirements if applicable.
13. Submittals and Closeout
The Contractor shall submit, as applicable:
Construction schedule.
Schedule of values.
Safety plan.
Quality control plan.
Product data and shop drawings.
Material certifications.
Daily reports and Contractor Production Reports.
Requests for information.
Warranty documents.
Operations and maintenance manuals.
Final cleanup and punch-list completion documentation.
14. Special Notes regarding System of Award Management (SAM)
System updates may lag policy updates. The SAM may continue to require entities to complete representations and certifications based on provisions that are not included in this solicitation. Examples include 52.222-25, Affirmative Action Compliance, and paragraph (d) of 52.212-3, Offeror Representations and Certifications Commercial Products and Commercial Services. Contracting officers will not consider these representations when making award decisions or enforcing requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.
15. Special Notes regarding FAR 52.229-3: Federal, State and Local taxes
Offerors are hereby notified that under 36 Maine Revised Statutes Annotated §1760-C, no tax on sales, storage or use may be collected upon or in connection with tangible personal property that is to be physically incorporated in, and become a permanent part of, real property for sale to the Federal Government, except as otherwise provided by Section §1760-C.
Therefore, the contractor s purchase of such tangible personal property within Maine that is to be physically incorporated in, and become a permanent part of, real property belonging to the U.S. Department of Veterans Affairs (VA) is subject to the exemption from Maine s state sales and use tax. To take advantage of the tax exemption the successful offeror under this solicitation must complete Form ST-A-119 Contractor s Exempt Purchase Certificate when it purchases construction materials for this contract and keep on file as required by the state of Maine tax laws.
Notwithstanding FAR 52.229-3, all bids received in response to this solicitation are presumed to reflect this tax exemption and therefore should not include state of Maine sales and use tax on sales of materials for incorporation into VA real estate under this contract.
