E.3 52.212-2 EVALUATION COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(1) Technical Capability
(2) Past Performance
(3) Price
Technical and past performance, when combined, are more important than price. The best value trade-off process technique will be used. An award will be made based on the best overall (i.e., best value) proposals that are determined to be the most beneficial to the Government, with appropriate consideration given to the following evaluation factors: Technical, Past Performance, and Price.
Basis for the award.
IAW RFO 12.203(c)(2) Evaluation of Quotations; The contracting officer has broad discretion in establishing how quotations will be evaluated. For this Solicitation, the contracting officer will perform a comparative evaluation of quotations. The Government will award a contract resulting from this solicitation to the responsible offeror whose quote, conforming to the solicitation, will be most advantageous to the Government, based on price and other factors considered. The following factors shall be used to evaluate offers/quotes: Price, Past Performance, and Technical Capability.
Evaluation Approach: The Government will evaluate quotations using the comparative evaluation process outlined in RFO 12.203(c)(2) Evaluation of Quotations, where quotations will be compared to one another to determine which provides the best benefit to the Government.
The Government reserves the right to consider a quotation other than the lowest price that provides additional benefit(s). Quotations may exceed the minimum requirements of the solicitation.
The Government reserves the right to select a quotation that provides a benefit to the Government that exceeds the minimum requirements of the solicitation, but is not required to do so.
Each response must meet the minimum requirements of the solicitation. The Government is not requesting or accepting alternate quotations.
(1) Technical Capability: The Quotation will be evaluated to the extent to which it can meet and/or exceed the Government's requirement as outlined in the solicitation s Statement of Work (SOW) and the evaluation s factors. The contractor shall clearly state its capabilities and Mobile MRI and Trailer Salient Characteristics to meet all requirements in the SOW, including providing all documentation described in provision 52.212-1, Instructions to Offerors. The vendor should provide evidence for all factors that require certifications and/or licenses. Each task and qualification described in the SOW will be evaluated for each vendor. The quotation will be evaluated to the extent to which it can meet and/or exceed the Government s requirements as outlined in the solicitation and based on the information requested in the instructions to quoters section of the solicitation.
(2) Past Performance: The past performance submissions will primarily determine the competency of the offeror s historical performance, and how that competency can be employed to predict the offeror s success in performing the task(s) listed in the solicitation. The Government will evaluate past performance for: Recent, Relevant, and Successful Past Performance in the Performance of Mobile MRI Lease Services commensurate with the magnitude of the services required per the SOW. The Government reserves the right to use information obtained from other sources, such as databases, to provide a reasonable basis for evaluating past performance.
The past performance evaluation will assess the relative risks associated with a quoter s likelihood of success in fulfilling the solicitation s requirements as indicated by the quoter s record of past performance. The past performance evaluation may be based on the contracting officer s knowledge of and previous experience with the supply or service being acquired; Customer surveys, past performance questionnaire replies, Contractor Performance Assessment Reporting System (CPARS) at http://www.cpars.gov/; or any other reasonable basis.
(3) Price: The Government will evaluate the price by adding the total of all line-item prices for all ordering periods. As part of the price evaluation, the government is evaluating the option to extend services, IAW FAR Clause 52.217-8, by dividing the last year's price in half to determine the price for the 6-month extension.
The Total Evaluated Price will be that sum (Price Schedule).
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
