PTAG Part 6.1.1 – Intent to Sole Source
For this procurement, the USPTO is exempt from most of the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). As a result of its exemptions, the USPTO is not required to meet the test of “full and open competition” as defined in FAR Part 6 and may use agency-specific acquisition procedures as described below when the circumstances warrant it and it is in the best interest of the agency to do so.
We have identified THE BUILDING PEOPLE LLC located at 215 Depot Ct SE FL3, Leesburg, VA 20175-3017. UEI: H294NPGNMEB5, a large business as the sole contractor able to effectively continue work on the IBM TRIRIGA configuration and as they are currently performing the system-related and integrated design tasks which remain unfinished. NAICS 561210 Facilities Support Services.
Specifically, the United States Patent and Trademark Office (USPTO) intends to award a logical follow-on sole-source purchase order to The Building People (TBP) to build upon and continue the interior design service support work utilizing and re-configuring the IBM TRIRIGA Integrated Workplace Management System (IWMS) for the administration, configuration, and support services at USPTO Headquarters in Alexandria, Virginia and other USPTO facilities.
TBP are currently in the process of customizing and adjusting the USPTO’s IBM TRIRIGA platform to meet USPTO-specific business requirements, including system configuration, module development, report and dashboard creation, user support, and integration with USPTO design, space planning and occupancy management operations. It would not be fiscally responsible, prudent or in the best interest of USPTO to solicit new vendors at this time.
This action ensures continuity of ongoing system integration and development efforts and prevents disruption to active TRIRIGA solution implementation activities that have not yet reached full operational capability.
As a result, per PTAG 6.1.1 (d) USPTO intends to negotiate and award a logical follow-on firm fixed contract with The Building People LLC to meet this requirement.
This notice of intent is not a request for competitive proposals, nor will a solicitation be issued to the public.
